My name is Horace B. Cummings, I’m currently serving a life sentence without parole in a Florida penalty system in Crawfordville, Florida for First Degree Felony Murder. In 1997 My case was the most publicized in Jacksonville, Florida. I was a principal to another person who is currently on death row. Me and the other person had a joint trial, his transcripts are my transcripts the only difference is that the other person had a penalty phase and I didn’t. The publicity was all about in this case was an 3 year old little boy lost his life. Now for 26 years I’ve been in prison for being a principal to another person. I never had any contact with the 3 year old little boy. The other person acted alone when he kidnapped the child. Now the Former Head State Attorney stated on January 09,1998 sentencing proceeding that my role in this crime was relatively minor. Now on September 30,2018 the state of California passed the Bill SB-1437- Accomplice liability for felony murder, this bill fits me to a tee. For the last 26 years, I’ve been writing organizations, lawyers, senators, Presidents, congressmen, congresswoman, state attorneys, attorneys generals, etc about the unfairness of the Florida felony murder rule and statues. I’ve earned several trade’s and certificates since I’ve been incarcerated for 26 years. Now the Head State Attorney didn’t want to give me a life sentence, but the law for First Degree Felony Murder he had no choice but to follow the law. This particular case is important for several reasons. First, it highlights the unjust and unethical application of the felony murder rule. Approximately half of the States allow a person to be convicted of First Degree Felony Murder, Even if the jury believes the person didn’t commit the act of murder. This is possible because in many States if a person is charged with murder and another Felony such as aggravated assault or burglary, the jury only need find the person guilty of the lesser felony offense for the individual to receive an egregious sentence such as life without parole. Now that California has passed the Bill SB- 1437, I need advocates to push for Florida to pass the same Bill in Florida. In 2021 Senate Bill SB- 478 (Murder Felony Murder-Non Killer) and House Bill 83(2021) died in Judiciary in Florida on April 30,2021.The Bill in California state’s that an person who doesn’t commit the murder should be sentenced to 25, 20, or 15 years. I’ve already served 26 years.
